8. Formal Investigations

Under section 196E of the VEA the Repatriation Commission, the Military Rehabilitation and Compensation Commission, an ex-service person or eligible dependant, an organisation representing veterans or their dependants, or persons eligible to make a claim under the MRCA may ask the Authority to carry out an investigation in respect of a particular kind of injury, disease or death, or to review the contents of a Statement of Principles.

Thirty-four investigations have been concluded in 2005-2006, as follows:

4.  malignant neoplasm of the prostate
5.  osteoarthrosis
6.  cervical spondylosis
7.  thoracic spondylosis
8.  lumbar spondylosis
9.  toxic encephalopathy
10. peripheral neuropathy
11. sudden unexplained death
12. malignant neoplasm of the pancreas
13. epileptic seizure
14. epilepsy
15. dermatomyositis
16. steatohepatitis
17. narcolepsy
18. malignant neoplasm of the larynx
19. spondylolisthesis & spondylolysis
20. motor neuron disease
21. malignant neoplasm of the thyroid gland
22. acute stress disorder
23. heart block (complete)
24. soft tissue sarcoma
25. carcinoma-in-situ of the skin
26. non-melanotic malignant neoplasm of the skin
27. malignant neoplasm of the lung
28. Paget’s disease of bone
29. vascular dementia
30. malignant neoplasm of the breast
31. osteoporosis
32. osteopaenia
33. seborrhoeic keratosis
34. macular branch vein occlusion

The investigations relating to seborrhoeic dermatitis [1], toxic encephalopathy [9], peripheral neuropathy [10], steatohepatitis [16], narcolepsy [17], heart block (complete) [23], vascular dementia [29] and macular branch vein occlusion [34] resulted in the determination of new Statements of Principles concerning seborrhoeic dermatitis, solvent-related chronic encephalopathy, Guillain-Barre syndrome, steatohepatitis, narcolepsy, heart block, vascular dementia and retinal vascular occlusive disease.

The investigation relating to peripheral neuropathy [10] resulted in the revocation of the existing Statements of Principles and the determination of new Statements of Principles concerning peripheral neuropathy, as well as the new Statement of Principles concerning Guillaine-Barre syndrome referred to above.

The investigation relating to sudden unexplained death [11] resulted in the revocation of the existing Statements of Principles and the determination of new Statements of Principles concerning sudden unexpected death.

The investigation relating to motor neuron disease [20] resulted in the revocation of the existing Statements of Principles and the determination of new Statements of Principles concerning motor neurone disease.

The investigations relating to carcinoma-in-situ of the skin [25] and non-melanotic malignant neoplasm of the skin [26] resulted in the revocation of the existing Statements of Principles and the determination of new Statements of Principles concerning non-melanotic malignant neoplasm of the skin, incorporating carcinomain- situ of the skin.

The investigation relating to osteopaenia [32] resulted in a declaration that the Authority would not determine a Statement of Principles concerning osteopaenia on the grounds that it was not an injury or disease as defined by section 5D(1) of the VEA.

All other investigations finalised during 2005-06 resulted in the revocation of existing Statements of Principles and the determination of new Statements of Principles.

The following investigations previously notified have not been concluded as at 30 June 2006:

29. alpha-1 antitrypsin deficiency;

38. hepatitis A;

The following investigations notified in the gazette during 2005-2006 have not been concluded as at 30 June 2006:

1.  dyspepsia;
2.  cirrhosis of the liver;
3.  malignant neoplasm of the endometrium;
4.  malignant neoplasm of the bladder;
5.  macular degeneration;
6.  pterygium;
7.  acquired cataracts;
8. malignant neoplasm of the skin;
9.  malignant neoplasm of the epithelium;
10. peritoneal adhesions;
11. shin splints;
12. non-melanotic malignant neoplasm of the skin;
13. lipoma;
14. ingrown toenail;
15. cholelithiasis;
16. external bruises & external contusions;
17. mesothelioma;
18. cuts, stabs, abrasions or lacerations;
19. analgesic nephropathy;
20. diverticular disease of the colon;
21. opisthorchiasis;
22. clonorchiasis;
23. trigeminal neuralgia;
24. sickle-cell disease;
25. benign prostatic hypertrophy;
26. benign neoplasm of the eye;
27. malignant neoplasm of the urethra;
28. pinguecula;
29. sarcoidosis;
30. presbyopia;
31. otosclerosis;
32. polymyalgia rheumatica;
33. relapsing polychondritis;
34. idiopathic thrombocytopaenic purpura;
35. spasmodic torticollis;
36. fibromuscular dysplasia;
37. cardiac myxoma.

As at 30 June 2006, the Authority had also received fifteen requests for review under sub-section 196E(1)(f) of the VEA in respect of which it decided not to carry out an investigation. Fourteen of these decisions not to carry out an investigation were made under section 196CA, one request for review was refused under sub-section 196C (4) and in each case written reasons were provided to the person or organisation making the request.

No requests for review under sub-section 196E(1)(e) were refused.

In summary, as at 30 June 2006, the Authority has completed 34 investigations and decided not to undertake 15 investigations over the 12-month period, and has ongoing investigations in respect of 89 conditions.
