9. Appeals to the Specialist Medical Review Council
Under the legislation, the Repatriation Commission, an ex-service person
or an organisation representing veterans may ask the Specialist Medical
Review Council to review:
- a Statement of Principles; or
- a decision of the Repatriation Medical Authority not to determine
a Statement of Principles in respect of a particular kind of injury,
disease or death; or
- a decision by the Repatriation Medical Authority under subsection
196C(4) of the VEA not to carry out an investigation in respect of a
particular kind of injury, disease or death.
Prior to 30 June 1996, the Specialist Medical Review Council had advised
the RMA that a request for review had been received from an individual
veteran relating to Statements of Principles No.83 of 1995 and No.84 of
1995 concerning hypertension.
Prior to the 30 June 1997, the Specialist Medical Review advised the
RMA that a request for review had been received in relation to Statement
of Principles No.191 of 1996 concerning malignant neoplasm of the prostate.
Prior to 30 June 1999, the Specialist Medical Review advised the RMA
that a request for review had been received in relation to Statements
of Principles No.80 of 1998 and No.81 of 1998 concerning ischaemic heart
disease.
In November 1999, the Specialist Medical Review advised the RMA that
a request for review had been received in relation to Statements of Principles
No.44 of 1999 and No.45 of 1999 concerning non-Hodgkins lymphoma.
In December 1999, the Specialist Medical Review advised the RMA that
a request for review had been received in relation to Statements of Principles
No.70 of 1999 and No.71 of 1999 concerning secondary Parkinsonism.
In January 2000, the Specialist Medical Review advised the RMA that a
request for review had been received in relation to Statement of Principles
No.72 of 1999 concerning myeloma.
The RMA has not been advised of the outcome of the above reviews as at
30 June 2000.
